1. Who we are
EV Freedom ("EV Freedom", "we", "us", "our") operates a flat-rate unlimited electric vehicle charging membership and related concierge services accessible through www.evfreedom.energy and any affiliated apps or phone lines (collectively, the "Service"). Our office is located in Los Angeles, California, and we serve members across all 50 U.S. states through our partner networks.
EV Freedom is an owner-operated business and formation of a registered legal entity is in progress; until that registration is complete, the owner identified on our Who We Are page is responsible for the obligations of the business. That page also names the owner, the payment processor that receives your payment, and our commitment for prepaid balances if the Service ever winds down — and it is updated as our legal status changes.
2. Eligibility & account
You must be at least 18 years old and legally able to enter into a contract to use the Service. You are responsible for keeping your account credentials, phone number, and vehicle information accurate and up to date. You are responsible for all activity that occurs under your account.
3. Membership plans
EV Freedom offers 1-day passes, 3-day passes, weekly recurring memberships, concierge valet service, and one-time charging sessions. The features, price, and any usage guidelines for each plan are described on our Pricing page. We may from time to time introduce new plans, promotions, or discount codes; the terms of any promotion govern that promotion.
Flat-rate memberships are intended for personal, non-commercial passenger EV use. Commercial fleet, rideshare-at-scale, or resale of charging sessions is not included and may require a separate agreement.
3a. Wallet balance & charging credits
Your account includes a prepaid Wallet. Funds you deposit, promotional credits, referral rewards, and gifted credits are held as a stored balance on your EV Freedom account. Wallet balances:
- are denominated in U.S. dollars and may only be used to pay for EV Freedom memberships, sessions, packages, and services;
- are not a bank deposit, are not insured, earn no interest, and are not redeemable for cash;
- may unlock a deposit-based discount or bonus credit as described at the time of the top-up — the applicable bonus tier is shown before you confirm;
- are non-refundable once applied to a purchase, consistent with our Refund Policy;
- may be gifted or shared with another member where the feature is offered; once transferred, the credit belongs to the recipient's account.
Bonus and promotional credits have no cash value, may expire, and may be revoked if we detect abuse, self-referral, duplicate accounts, or reversed payments.
3b. Referrals & invites
Referral and invite rewards are issued only when the invited person completes the qualifying action described in the portal at the time of the invite. Referring yourself, creating duplicate or fake accounts, spamming invite links, or otherwise gaming the program forfeits all rewards and may result in suspension. We may change or end the referral program at any time.
4. Charger activation & third-party networks
EV Freedom activates charging sessions on your behalf across third-party networks including EVgo, ChargePoint, Flo, Electrify America, and Tesla. We do not own or operate these chargers. Charger availability, output, uptime, connector compatibility, and per-station rules are controlled by the network operator and the site host. We are not responsible for network outages, damaged equipment, queue times, or a specific station being unavailable.
Station and availability data. Station locations, connector types, power ratings, pricing, and "stall in use / available" indicators shown on our map come from third-party data sources and network APIs. This information is provided for convenience, can be delayed or incorrect, and is not a guarantee that a specific stall will be free, working, or compatible when you arrive.
4a. Route planner, range estimates & AI features
Our route planner, charging-stop suggestions, savings comparisons, and any AI-assisted answers, drafts, or recommendations are estimates and informational only. They rely on third-party mapping, traffic, weather, station, and vehicle data and on assumptions about efficiency, temperature, payload, and driving style. Actual range, arrival state of charge, cost, and savings will vary. You are solely responsible for operating your vehicle safely and for your own routing decisions — do not interact with the Service while driving.
4b. Connecting your vehicle
If you choose to link your car, you authorize us to connect to your vehicle account through our telematics provider (Smartcar) and to read the data you approve during the connection flow — typically battery level, range, odometer, charge status, and location. We use that data only to personalize charging, route planning, and support. You can disconnect your vehicle at any time from the portal, which revokes our access going forward. We never send remote commands to your vehicle beyond the permissions you explicitly grant.
4c. Home charger quotes & installation
Home-charger quotes and estimates generated on our site are non-binding preliminary estimates based on the information you provide and on market pricing data we collect from public sources and suppliers. Final pricing requires a site assessment. Electrical work, permitting, and installation are performed by independent licensed contractors and suppliers, not by EV Freedom; the installing contractor is responsible for its own workmanship, warranty, licensing, and code compliance. We are not liable for the acts or omissions of third-party installers, though we will help coordinate resolution.
4d. Messaging, calls & recordings
By providing your phone number you consent to receive transactional and service messages from EV Freedom by SMS and phone, including pump-availability alerts, session and billing notices, and support replies. Marketing texts and emails are sent only if you opt in. Message and data rates may apply; message frequency varies. Reply STOP to any text to opt out of that message stream and HELP for help. Opting out of marketing does not stop essential account or billing notices. Our portal also offers in-app voice calling with our support team; we may record or transcribe support conversations for quality, training, and dispute resolution where permitted by law, and we will disclose recording at the start of a call when required.
5. Acceptable use
- Use the Service only for your own registered vehicle(s).
- Do not share your account, membership QR, or activation credentials with anyone else.
- Do not attempt to activate chargers for vehicles you do not own or control.
- Do not resell, sublicense, or commercially exploit the Service.
- Do not scrape, reverse-engineer, or otherwise attempt to extract our software, pricing logic, or member data.
- Do not probe, scan, or attempt to bypass our security controls, rate limits, or admin areas. Automated abuse is blocked and logged.
We may suspend or terminate any account that violates these rules, engages in fraud or chargeback abuse, or creates a safety or network-integrity risk.
6. Billing, renewals & taxes
Recurring memberships bill automatically on the same day each cycle using the payment method on file, until cancelled. One-time sessions bill immediately at checkout. All charges are in U.S. dollars. Applicable sales taxes are calculated and collected at checkout by our payment processor.
If a payment fails, we may retry the charge and pause your ability to activate chargers until the balance is settled. You may save payment methods to your account for future top-ups and renewals; saved cards are stored by our payment processor (Stripe), not by us, and you can add or remove them at any time in your Wallet. Where a project is quoted with a deposit and a balance, the deposit is due before work is scheduled and the balance is due as stated on the invoice.
7. Cancellations
You can cancel a recurring weekly membership or concierge plan at any time from your account or by contacting support; cancellation stops future renewals and takes effect at the end of the current billing period. Day passes, 3-day passes, and one-time sessions do not renew — they simply expire at the end of the pass window.
If we discontinue the Service, we will give active members at least 30 days' advance notice by email, stop recurring billing immediately upon that notice, and keep your existing Wallet balance usable as service credit during the notice period and through any term you have already paid for. Wallet balances are service credit and are not redeemable for cash except where applicable law requires it. Full commitment: Who We Are.
8. Refunds
All sales are final. EV Freedom does not offer refunds, pro-rated credits, or partial refunds on memberships, session passes, or add-ons, except where required by applicable law or expressly stated in a promotion. See our Refund Policy for the full details, including the narrow exceptions we honor.
9. Intellectual property
The EV Freedom name, logo, website, software, content, and design are owned by EV Freedom and protected by U.S. and international intellectual property laws. Your membership grants you a personal, limited, non-transferable, revocable license to use the Service. Nothing in these Terms transfers any ownership of our IP to you.
10. Disclaimers
The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, EV Freedom disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding charger uptime, session speed, or nationwide availability.
11. Limitation of liability
To the fullest extent permitted by law, EV Freedom's total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to EV Freedom in the twelve months before the claim, or (b) US $100. In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, including damage to your vehicle from a third-party charger, lost profits, or lost data.
12. Indemnification
You agree to indemnify and hold harmless EV Freedom, its officers, employees, and partners from any claim arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
13. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction and venue. Where permitted by law, you and EV Freedom waive the right to a jury trial and to participate in a class action.
14. Changes to these terms
We may update these Terms from time to time. If we make a material change, we will update the "Effective" date above and, where appropriate, notify active members by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
