Terms of Service

Please read these terms carefully. By using EV Freedom you agree to them.

Effective July 10, 2026

1. Who we are

EV Freedom ("EV Freedom", "we", "us", "our") operates a flat-rate unlimited electric vehicle charging membership and related concierge services accessible through www.evfreedom.energy and any affiliated apps or phone lines (collectively, the "Service"). Our office is located in Los Angeles, California, and we serve members across all 50 U.S. states through our partner networks.

2. Eligibility & account

You must be at least 18 years old and legally able to enter into a contract to use the Service. You are responsible for keeping your account credentials, phone number, and vehicle information accurate and up to date. You are responsible for all activity that occurs under your account.

3. Membership plans

EV Freedom offers monthly, annual, and one-time session memberships. The features, price, and any usage guidelines for each plan are described on our Pricing page. We may from time to time introduce new plans, promotions, or discount codes; the terms of any promotion govern that promotion.

Flat-rate memberships are intended for personal, non-commercial passenger EV use. Commercial fleet, rideshare-at-scale, or resale of charging sessions is not included and may require a separate agreement.

4. Charger activation & third-party networks

EV Freedom activates charging sessions on your behalf across third-party networks including EVgo, ChargePoint, Flo, Electrify America, Blink, and Tesla. We do not own or operate these chargers. Charger availability, output, uptime, connector compatibility, and per-station rules are controlled by the network operator and the site host. We are not responsible for network outages, damaged equipment, queue times, or a specific station being unavailable.

5. Acceptable use

  • Use the Service only for your own registered vehicle(s).
  • Do not share your account, membership QR, or activation credentials with anyone else.
  • Do not attempt to activate chargers for vehicles you do not own or control.
  • Do not resell, sublicense, or commercially exploit the Service.
  • Do not scrape, reverse-engineer, or otherwise attempt to extract our software, pricing logic, or member data.

We may suspend or terminate any account that violates these rules, engages in fraud or chargeback abuse, or creates a safety or network-integrity risk.

6. Billing, renewals & taxes

Recurring memberships bill automatically on the same day each cycle using the payment method on file, until cancelled. One-time sessions bill immediately at checkout. All charges are in U.S. dollars. Applicable sales taxes are calculated and collected at checkout by our payment processor.

If a payment fails, we may retry the charge and pause your ability to activate chargers until the balance is settled.

7. Cancellations

You can cancel a monthly membership at any time from your account or by contacting support; cancellation stops future renewals and takes effect at the end of the current billing cycle. Annual memberships run for the full paid term and do not auto-renew unless you enable renewal.

8. Refunds

All sales are final. EV Freedom does not offer refunds, pro-rated credits, or partial refunds on memberships, session passes, or add-ons, except where required by applicable law or expressly stated in a promotion. 9. Intellectual property

The EV Freedom name, logo, website, software, content, and design are owned by EV Freedom and protected by U.S. and international intellectual property laws. Your membership grants you a personal, limited, non-transferable, revocable license to use the Service. Nothing in these Terms transfers any ownership of our IP to you.

10. Disclaimers

The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, EV Freedom disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding charger uptime, session speed, or nationwide availability.

11. Limitation of liability

To the fullest extent permitted by law, EV Freedom's total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to EV Freedom in the twelve months before the claim, or (b) US $100. In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, including damage to your vehicle from a third-party charger, lost profits, or lost data.

12. Indemnification

You agree to indemnify and hold harmless EV Freedom, its officers, employees, and partners from any claim arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction and venue. Where permitted by law, you and EV Freedom waive the right to a jury trial and to participate in a class action.

14. Changes to these terms

We may update these Terms from time to time. If we make a material change, we will update the "Effective" date above and, where appropriate, notify active members by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
